Terms and conditions of sale

1. Purpose

These General Terms and Conditions of Sale govern all transactions made with Éclat d’Océan, a sole proprietorship specialising in the handcrafting and sale of unique sea glass jewellery, both on the website www.eclat-ocean.com and during direct sales by payment terminal (TPE).

Éclat d’Océan is a micro-enterprise under the VAT franchise scheme (VAT not applicable - article 293 B of the French General Tax Code, CGI).

3. Acceptance of the terms

Placing an order implies unreserved acceptance of these terms. The customer acknowledges having read them before any purchase, whether made on the site or in direct sale.

4. Products and handcrafting

Éclat d’Océan jewellery is entirely handcrafted in France. As each piece is unique, slight variations may exist due to its handmade nature.

5. Ordering

Orders are placed:

  • Online via www.eclat-ocean.com
  • Directly with Éclat d’Océan during physical sales (markets, fairs, events…) via mobile payment terminal (TPE).

An automatic confirmation is sent for online orders. Éclat d’Océan may refuse any order for a legitimate reason.

If an ordered product becomes unavailable after the order has been validated, Éclat d’Océan will inform the customer by email as soon as possible. The customer will then choose between a product of equivalent quality and price or a refund of the amount of the ordered product, made no later than thirty (30) days after payment. Apart from the refund, Éclat d’Océan owes no cancellation compensation.

6. Prices

Prices are shown in euros (€) and exclusive of tax (HT), in accordance with article 293 B of the CGI. Any shipping costs are clearly shown before the order is validated.

7. Payment

Payments can be made by:

  • Bank card (Visa, Mastercard, American Express)
  • PayPal
  • Bank transfer
  • Éclat d’Océan gift card
  • Mobile payment terminal (TPE) (during physical sales only)

An order is only validated once full payment has been received.

8. Order preparation

Éclat d’Océan prepares each order with the greatest care. Ordered items are generally shipped within 3 to 5 working days of receipt of full payment for the order.

9. Delivery

Deliveries are made by La Poste with tracking:

  • France: average delivery time of 3 to 5 working days
  • International: average delivery time of 5 to 15 working days depending on destination

Éclat d’Océan accepts no liability for delays or losses by the postal services.

On delivery, it is up to the customer to check that the products delivered match the order and that the parcel is sealed and undamaged. Otherwise, the customer must note it on the carrier’s delivery slip. No claim regarding the quantity or condition of the product will be accepted unless it has been duly noted on the delivery slip or reported to Éclat d’Océan within 48h of receipt.

10. Transfer of ownership and risk

Ownership of the products sold passes to the customer only after full payment. Risk passes as soon as the products are handed to the carrier.

11. Right of withdrawal

The customer has a legal period of 14 days from receipt of the product to exercise the right of withdrawal, with no reason required. Return costs are borne solely by the customer. Returns must be sent to: Tiffany Gruit (Éclat d’Océan) 8 chemin de l’Oustau, Apt 15 64230 Sauvagnon, France

Returned products must be unworn, in perfect condition and in their original packaging. The refund is made within 14 days of receipt and inspection of the returned products.

12. Personalised products

In accordance with article L.221-28 of the French Consumer Code, products made to measure or personalised are neither taken back nor exchanged.

13. Gift wrapping

Éclat d’Océan offers free gift wrapping and a personalised message on request when ordering.

14. Jewellery care

To keep your jewellery for a long time, it is recommended:

  • To avoid any prolonged contact with salt water, chlorinated water or chemicals.
  • To store the jewellery in the protective pouch provided.
  • To clean it regularly with a soft, dry cloth.

15. Environmental commitment

Éclat d’Océan promotes an ethical and eco-responsible approach by using exclusively naturally recycled sea glass, collected by a network of trusted people around the world. Each piece of jewellery thus contributes to respecting natural resources while giving a second life to these treasures shaped by the ocean.

16. Intellectual property

All the content of the site (photos, texts, graphics) is protected by copyright and intellectual property law. Any reproduction without prior written consent is prohibited and liable to prosecution.

17. Privacy and personal data

Under the GDPR, the customer has a right of access, rectification, deletion and objection to the processing of their personal data by writing to: contact@eclat-ocean.com.

Éclat d’Océan undertakes to archive order records and invoices on a reliable and durable medium, in accordance with article 1348 of the French Civil Code, constituting reliable proof of the contract.

18. Force majeure

Éclat d’Océan cannot be held liable in the event of force majeure (pandemic, strike, natural disaster, interruption of postal services, etc.).

19. Severability

If any provision of these terms were declared invalid by a competent court, this invalidity would not affect the other provisions, which would remain fully in force.

20. Changes to the terms

Éclat d’Océan may change its terms at any time. The applicable terms are those available on the site on the day of the order.

21. Mediation and dispute resolution

In the event of a dispute, the customer must first contact Éclat d’Océan by email (contact@eclat-ocean.com) to seek an amicable solution. Failing an amicable agreement, the customer may use mediation free of charge: Centre de médiation de la consommation des Conciliateurs de Justice (CM2C) 14 rue Saint-Jean, 75017 Paris Website: www.cm2c.net

If mediation fails, the dispute will be brought before the competent courts in France.

22. Legal guarantees

The products benefit from the legal guarantee of conformity (articles L217-4 and following of the French Consumer Code) and the guarantee against hidden defects (articles 1641 and following of the French Civil Code). In the event of a proven defective product (excluding normal wear or misuse), Éclat d’Océan undertakes to repair, replace or refund the product concerned after inspection. Return costs are initially borne by the customer. However, if the lack of conformity or hidden defect is confirmed after inspection, these costs will be refunded to the customer on presentation of proof of the costs incurred (standard shipping costs only, any other additional cost remaining payable by the customer).

23. Procedure for reviewing and publishing customer reviews

Éclat d’Océan undertakes to guarantee the authenticity and reliability of the reviews published by its customers on the site. This procedure aims to ensure the transparency and integrity of our review system.

Publication criteria: All reviews are moderated before publication. The criteria include: the relevance of the comment to the services, the absence of inappropriate, discriminatory or offensive language, and respect for the law and ethics.

Verification method:

  • Purchase verification: Only customers who have made a verified purchase can submit a review. Éclat d’Océan checks that each review is linked to a real purchase on the site.
  • Moderation: Reviews are moderated by Éclat d’Océan to make sure they meet the established criteria. We may contact the author of the review to ask for details if necessary.

Right of reply: Éclat d’Océan reserves the right to reply to any published review in order to clarify a situation or correct inaccurate information, in a respectful and constructive way.

Refusal and removal of reviews: Reviews that do not meet the publication criteria may be refused or removed. Éclat d’Océan reserves the right to remove a review after publication if new information shows that it no longer meets these standards.

Transparency: Éclat d’Océan undertakes to display all reviews (positive or negative) provided they meet the publication criteria, in order to give complete information to future customers.
